Terms of Service
Welcome to our Adventure Packages service. By booking or participating in any of our adventure packages, you agree to the following Terms of Service (“Terms”). Please read them carefully before booking or using our services.
Use of Service
Our adventure packages are designed to provide exciting and memorable outdoor experiences. By using our services, you agree to: Comply with all instructions from our guides and team members; Follow applicable laws and safety guidelines; Respect other participants, the environment, and local communities; Not engage in any illegal, harmful, or disruptive behavior.
Booking and Payment
All bookings are subject to availability and must be confirmed by us. Full payment is required at the time of booking unless otherwise specified. We accept payments via Stripe, Visa, Mastercard in US Dollar, Euro, British Pound, Swiss Franc. Bookings are not confirmed until payment is received and acknowledged in writing. Prices are inclusive of applicable taxes unless noted otherwise.
Minimum Participants
Certain adventures may require a minimum number of participants to proceed. If that minimum is not met, we reserve the right to cancel the trip and offer: A full refund, or A credit or transfer to another date or package.
Cancellation by Participant
You may cancel your booking by emailing us at info@x-peaks.com. The following fees apply: 30+ days prior to trip: 80% refund 15–29 days prior: 50% refund Less than 14 days: No refund
Cancellation by XPeaks
We reserve the right to cancel a trip due to: Severe weather or unsafe conditions Force majeure (e.g. natural disaster, political unrest) - Insufficient enrollment Guide or equipment unavailability In such cases, we will offer a full refund, credit, or the option to rebook. We are not responsible for additional costs incurred, such as flights, visas, or accommodation.
Itinerary & Weather Changes
We may alter itineraries, routes, or accommodations when necessary due to: Weather or environmental conditions Trail or road closures Safety concerns Availability issues These changes are not considered grounds for refund.
Participant Fitness and Preparation
By booking, you confirm that: You are in adequate physical and mental condition for the activity. You will follow all pre-trip training or preparation guidelines provided. You will inform us of any medical conditions or limitations prior to the trip.We may refuse participation if we believe your health or readiness may endanger yourself or others.
Health & Medical Disclosure
All participants must: Disclose any medical conditions, allergies, medications, or injuries; Understand that medical services may be limited or unavailable in remote areas. We reserve the right to deny participation if adequate health disclosures are not provided.
Insurance Requirements
We strongly recommend you purchase: Travel insurance covering delays, cancellations, and lost baggage Medical and emergency evacuation insurance, especially for high-altitude or remote-area trips It is your responsibility to ensure appropriate coverage before departure.
Assumption of Risk
Adventure travel involves inherent risks including but not limited to: Accidents, illness, or injury Equipment failure Extreme weather Altitude-related illness Wildlife encounters Delayed rescue or evacuation By participating, you voluntarily assume all such risks and agree to release XPeaks, its staff, contractors, and affiliates from liability to the maximum extent allowed by law.
Liability
To the fullest extent permitted by law, XPeaks shall not be liable for: Indirect or consequential damages Lost personal items or baggage Delays, missed connections, or third-party service failures Acts of God, war, pandemics, or governmental actions Our total liability is limited to the amount paid for your booking.
Third-Party Providers
Some services (accommodation, transport, guiding, meals) may be delivered by independent third parties. While we vet our partners, we are not liable for their performance, negligence, or conduct.
Behavior & Conduct
All participants must: Abide by local laws and customs Avoid use of alcohol or drugs during activities Treat guides and fellow travelers with respect Comply with environmental rules (e.g. leave-no-trace principles) We reserve the right to remove any participant without refund for disruptive, unsafe, or illegal behavior.
Minors
Participants under the age of 18 must: Be accompanied by a parent or legal guardian, or Provide a signed parental consent form prior to joining the trip We reserve the right to verify age and deny participation if consent is not properly provided.
Entry Requirements
Participants are responsible for: Holding a valid passport (with at least 6 months validity) Securing any required visas, permits, or vaccinations Meeting all destination country entry and transit requirements Failure to meet entry conditions does not entitle the participant to a refund.
Photos & Media Use
By participating in a trip, you consent to being photographed or filmed by our guides or photographers. These materials may be used in our: Website and social media Brochures and advertising Newsletters and email campaigns If you do not consent, you must notify us in writing before your trip.
Privacy Policy
We take your privacy seriously. Your personal data is collected and processed in accordance with our Privacy Policy, which complies with Swiss and international data protection laws (including GDPR).
Data Retention and Deletion
How long we retain your data: We retain your personal data only for as long as necessary to provide you with our services and for legitimate and essential business purposes, such as maintaining the performance of the XPeaks app, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes.
Specifically, we retain your data based on the following criteria:
Account Information: Retained for as long as your XPeaks account remains active.
Usage Data: Retained for 24 months for analytics and performance improvements, after which it is anonymized or deleted.
If applicable: Inactive Accounts: If your account is inactive for 36 months, we will automatically delete your account and associated personal data.
How to request data deletion: You have the right to request the deletion of your personal information. If you wish to delete your account or any personal data we have collected, you can do so by contacting us directly at info@x-peaks.com.
Upon receiving a deletion request, we will delete your data from our active databases within 7 working days, unless we are legally required to retain certain information.
Acknowledgement
By booking with XPeaks, you confirm that: You have read and understood these Terms; You accept all terms, policies, risks, and responsibilities outlined; You understand that failure to comply may result in removal from the trip without refund.
Force Majeure
We are not liable for delays, changes, or cancellations caused by: Natural disasters (earthquakes, storms) War, terrorism, political instability Government mandates, pandemics, or border closures Airline or transport disruptions We will make reasonable efforts to reschedule or provide alternative solutions.
Governing Law & Jurisdiction
These Terms are governed by the laws of Switzerland. Any disputes arising from your use of our services shall be subject to the exclusive jurisdiction of the courts of the Canton of Bern, unless otherwise required by applicable consumer protection laws.
Changes to Terms
We may update these terms of service from time to time. Any changes will be posted on this page, and your continued use of our service constitutes acceptance of the updated terms.
